  1. Introduction

Welcome to tellsmall.com (the “Platform”), operated by Tells Mall Limited (“we,” “us,” or “our”), a company registered under the laws of the Republic of Ghana.

These Terms and Conditions (“Terms”) govern your use of the Platform, including all related mobile applications, services, and tools we provide. By accessing or using the Platform, you agree to comply with these Terms. If you do not agree, please do not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted will mean you accept those changes.

 

  1. Eligibility

To use the Platform, you must:

  • Have the legal capacity to enter into contracts under Ghanaian law.

  1. User Accounts

When you create an account:

  • Security of Account: You are responsible for keeping your login details (username and password) secure.
  • Account Activity: Any activity under your account will be assumed to be by you, so keep your credentials confidential.
  • Multiple Accounts: Creating multiple accounts for fraudulent or deceptive purposes is not allowed.
  1. Acceptable Use

You agree not to engage in the following:

  • Posting False Information: All listings must be truthful and accurately describe the product or service. Misrepresentation is prohibited.
  • Illegal Activities: You may not list or promote goods or services that are illegal under Ghanaian law.
  • Harassment and Spam: You may not send spam, unsolicited messages, or harass other users.
  • Content Theft: You may not copy or reproduce other users’ content without their permission.
  • Hacking or Tampering: Attempting to hack, modify, or disrupt the Platform is strictly prohibited.
  1. Listings and Content
  • User Responsibility: You are solely responsible for the content of your listings, including descriptions, prices, and images.
  • Right to Remove Content: We reserve the right to remove or modify listings at any time if they violate these Terms or applicable laws.
  • Intellectual Property: You must have the rights to any content you post (text, images, videos). Do not upload copyrighted material without permission.
  • Accuracy: Ensure your listing accurately represents what you are offering to avoid misleading buyers.
  1. Transactions and Payments Between Users
  • No Involvement in Transactions: Tells Mall Limited is not a party to transactions between buyers and sellers. We simply provide the platform for users to connect.
  • User Risk: Any payment, delivery, or exchange between users is at their own risk.
  • No Guarantees: We do not guarantee the quality, safety, legality, or authenticity of goods and services listed.
  1. Fees and Services
  • Free and Paid Services: Posting basic ads may be free, but premium features such as ad promotions or highlighted listings may require payment.
  • Fee Changes: We reserve the right to change fees for services with prior notice posted on the Platform.
  • Billing Terms: See our detailed Billing Policy for payment, refunds, and charges.
  1. Limitation of Liability

We are not liable for:

  • Any direct, indirect, incidental, or consequential losses from use of the Platform.
  • Damages caused by reliance on user-generated content.
  • Interruptions or delays in service, whether caused by maintenance, technical errors, or force majeure events.
  1. Indemnification

You agree to defend, indemnify, and hold harmless Tells Mall Limited, its employees, and partners from any claims, liabilities, damages, or expenses arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your infringement of any third-party rights.
  1. Prohibited Items and Services

Prohibited listings include, but are not limited to:

  • Illegal drugs or controlled substances.
  • Firearms, ammunition, and explosives.
  • Stolen property.
  • Counterfeit currency, goods, or documents.
  • Pornographic material involving minors.
  • Endangered wildlife or products derived from them.
    This list may be updated at any time to reflect legal requirements.
  1. Termination of Account

We may suspend or terminate your account without prior notice if you:

  • Breach these Terms.
  • Engage in activities harmful to the Platform or its users.
  • Violate Ghanaian laws in your use of the Platform.
  1. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved in the courts of Ghana.
